Recent regulations under the Americans with Disabilities Act (ADA) went into effect in March and raise a number of new, and some old, questions for the land conservancy community :
What are your organization’s general responsibilities under the ADA if you provide “public accommodation” on your protected lands?
What are your obligations under new regulations regarding “power-driven mobility devices” should you wish to prohibit motorized vehicles from sensitive lands?
Need you only be concerned about fee-owned lands or are conservation easements that allow public access affected as well?
What steps is your conservancy taking to provide accessibility for people with disabilities?
Lead attorney Ellen Fred will help sort out the answers in a one-hour call about this important public policy. As one of our regular attorneys on the Ask An Attorney series, Ellen serves clients on all aspects of land conservation law, including drafting and customizing conservation easements. She is also the author of a 2003 law journal article, “Outdoor Accessibility Requirements of the Americans with Disabilities Act: Must Holders of Conservation Easements Provide ADA Access?”. Join us!

How to participate: The Ask An Attorney/Expert conference call is available to representatives of all Michigan land conservancies and their conservation partners. Call-in number, pass code, call-in protocol and other instructions will be provided once you’ve signed up. Please note that the call-in number is NOT toll-free. For the reasonable cost of a long distance call or 60 cell phone minutes, you’ll have access to some of best conservation expertise in Michigan.
Remember: The Ask An Attorney/Ask An Expert program is intended to provide general guidance only and is not a substitute for seeking needed legal review by a qualified attorney for conservation easements or other land transactions.
